Let Φ=Φ(G) in a finite group. If H⊴G contains Φ and H/Φ is a nilpotent group, every Sylow subgroup P of H has PΦ⊴G. The Frattini argument gives G=(PΦ)NG(P)=ΦNG(P), and the defining non-generator property of Φ forces NG(P)=G. Hence H is a nilpotent group.
